TERMS OF SERVICE — THE FITNESS SYNDICATE

Welcome to The Fitness Syndicate. By using our website, mobile application, or gym facilities, you agree to these Terms of Service. Please read them carefully.

  1. ACCEPTANCE OF TERMS

By creating an account, purchasing a membership, booking a class, or using any of our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

  1. MEMBERSHIP

2.1 Eligibility: You must be at least 18 years old to purchase a membership. Individuals aged 13-17 may participate with parental or guardian consent and supervision as required.

2.2 Membership Plans: We offer various membership plans including monthly recurring, annual, day passes, and guest passes. Current pricing is available on our website and at the gym. Prices are subject to change with 30 days notice to existing members.

2.3 Recurring Payments: Monthly memberships are billed automatically on or near the same date each month using the payment method on file. It is your responsibility to keep your payment information current.

2.4 Cancellation: You may cancel your membership at any time through your online member dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial billing periods.

2.5 Failed Payments: If a payment fails, we will attempt to retry the charge. You will be notified by email. Continued payment failures may result in membership suspension.

  1. GYM ACCESS AND CONDUCT

3.1 24/7 Access: Members with active memberships may access the facility 24/7 via Bluetooth key. Access is automatically disabled when a membership expires, is suspended, or is terminated.

3.2 Guest Policy: Members may bring guests for a fee. Guests must sign a liability waiver before using the facility.

3.3 Conduct: All members and guests are expected to conduct themselves respectfully. We reserve the right to revoke membership for behavior that endangers others, damages equipment, or disrupts the gym environment. No refund will be issued for memberships revoked due to misconduct.

3.4 Equipment: Use all equipment at your own risk. Report any damaged or malfunctioning equipment to staff immediately.

  1. CLASS BOOKINGS

4.1 Reservations: Class spots may be reserved online or through the mobile app. Some classes may have capacity limits.

4.2 Cancellation Policy: Class reservations may be cancelled up to 2 hours before the scheduled start time. Cancellations within 2 hours of class start are not permitted.

4.3 Drop-In Pricing: Non-members or members without class-inclusive plans may attend classes at the posted drop-in rate.

4.4 Waitlist: If a class is full, you may join a waitlist. You will be notified if a spot becomes available.

  1. LIABILITY WAIVER

5.1 All members and guests must sign a digital liability waiver before using the facility or participating in any classes or programs.

5.2 The waiver text is provided by The Fitness Syndicate and represents the agreement between you and The Fitness Syndicate regarding assumption of risk and release of liability.

5.3 Waiver content is provided by the business owner. The technology platform, operated by ALICE Digital, LLC, provides the digital signature collection and storage technology. ALICE Digital, LLC is not a party to the waiver agreement and assumes no liability for the content, enforceability, or legal sufficiency of any waiver presented through the platform.

5.4 We recommend that all liability waivers be reviewed by a qualified attorney. The Fitness Syndicate is solely responsible for ensuring its waiver content is accurate and legally compliant.

  1. PAYMENTS AND BILLING

6.1 Payment Processing: All payments are processed securely by Stripe. We accept major credit cards, debit cards, Apple Pay, Google Pay, and ACH bank transfers.

6.2 Receipts: Transaction receipts are sent via email or text message as requested at the time of purchase.

6.3 Refunds: Refund policies vary by purchase type. Class drop-in fees may be refunded if a class booking is cancelled within the allowed cancellation window. Membership fees are generally non-refundable for the current billing period. Contact us for specific refund requests.

6.4 Disputes: If you believe a charge is incorrect, contact us at train@thefitnesssyndicate.com within 30 days of the charge.

  1. COMMUNICATION

7.1 By providing your email address and/or phone number, you consent to receive transactional communications including booking confirmations, payment receipts, membership notifications, and account alerts.

7.2 You may also opt in to receive promotional messages. You can opt out of promotional messages at any time by replying STOP to any text message or clicking unsubscribe in any email.

7.3 Transactional messages (payment confirmations, booking changes, security alerts) cannot be opted out of while you maintain an active account, as they are necessary for service delivery.

  1. INTELLECTUAL PROPERTY

8.1 The Fitness Syndicate name, logo, and branding are the property of Brooks Fit, LLC.

8.2 The platform, including its software, design, and features, is the property of ALICE Digital, LLC and is provided to The Fitness Syndicate under license.

8.3 Content you submit (profile information, photos, feedback) remains yours, but you grant us a limited license to display it within our platform for service delivery purposes.

  1. TECHNOLOGY PLATFORM

9.1 Our website, member portal, and mobile application are developed and maintained by ALICE Digital, LLC.

9.2 ALICE Digital, LLC provides the technology platform and is not responsible for gym operations, membership decisions, class scheduling, trainer qualifications, or facility conditions.

9.3 Service availability is subject to occasional maintenance and updates. We strive for continuous availability but do not guarantee uninterrupted access.

  1. PRIVACY

Your privacy is important to us. Please review our Privacy Policy at thefitnesssyndicate.com/privacy for details on how we collect, use, and protect your personal information.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, The Fitness Syndicate, Brooks Fit, LLC, and its owners, employees, trainers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our facilities, services, or platform.

  1. CHANGES TO TERMS

We may update these Terms from time to time. Material changes will be communicated via email or posted on our website. Continued use of our services after changes constitutes acceptance.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Idaho. Any disputes shall be resolved in the courts of Ada County, Idaho.
